Terms & Conditions for Casheze Technologies India Private Limited Services

By accessing or using the Casheze website, mobile application, platform, or any of the services provided by Casheze Technologies India Private Limited (“Casheze”, “Company”, “we”, “us” or “our”), you agree to be bound by these Terms & Conditions (“Terms”). Please read these Terms carefully before using our Services.

Casheze Technologies India Private Limited owns and/or operates its website, mobile application, digital platforms and other online or offline interfaces through which users may access products, services, offers, transactions and other facilities provided by Casheze and/or its third-party partners.

The website, mobile application, platform, technology, content and related functionality, whether provided through the website, application or any other means, are collectively referred to as the “Services.”

If you do not agree with any part of these Terms & Conditions, you must not access or use the Site or Services. Your continued use of the Site or Services shall constitute your acceptance of these Terms, as amended or updated by Casheze from time to time.

1. Casheze as a Platform

Casheze operates a technology-enabled platform that facilitates users in accessing products, services, transactions and related facilities offered by Casheze and/or third-party service providers, merchants, vendors, partners and other entities (“Third Parties”).

Depending upon the nature of the transaction, Casheze may act as a platform, facilitator, marketplace, technology provider, service provider or intermediary.

Where a transaction is directly between the user and a Third Party, Casheze may not be directly involved in every aspect of such transaction. The applicable Third Party shall remain responsible for the products or services directly provided by it to the user.

2. Permitted Use and Compliance with Laws

Casheze grants you a limited, non-exclusive, non-transferable and revocable right to access and use the Site, Application and Services for lawful purposes and in accordance with these Terms.

You agree that you shall:

• Use the Services only for lawful purposes.
• Comply with all applicable laws, rules and regulations.
• Provide accurate and complete information wherever required.
• Not misuse, manipulate, disrupt or interfere with the Services.
• Not attempt to gain unauthorized access to any system, account, server or network connected with Casheze.
• Not copy, reproduce, modify, distribute, sell, transmit or commercially exploit Casheze's content, software or intellectual property without prior written permission.
• Not undertake any activity that may adversely affect the security, availability or performance of the Services.

Casheze reserves the right to suspend, restrict or terminate access to any user who violates these Terms or applicable laws.

3. Intellectual Property Rights

Unless otherwise stated, all content available on the Casheze platform, including text, software, designs, graphics, photographs, videos, logos, trademarks, service marks, icons, user interfaces and other materials, are owned by or licensed to Casheze Technologies India Private Limited and are protected under applicable intellectual property laws.

You shall not use, reproduce, modify, publish, distribute, transmit, display or commercially exploit any Casheze intellectual property without obtaining prior written authorization from Casheze.

Third-party trademarks, logos and brand names appearing on the platform remain the property of their respective owners.

4. Casheze Services and Third-Party Services

Casheze may provide information relating to products, services, prices, offers, merchants, vendors, partners and other Third Parties through its platform.

While Casheze may take reasonable efforts to ensure that information displayed on the platform is accurate, Casheze does not guarantee that all Third-Party Information will always be complete, accurate, current or error-free.

Where a user enters into a transaction directly with a Third Party, the terms applicable to that transaction may be governed by the terms, policies and conditions of the relevant Third Party.

Casheze shall not be responsible for the acts, omissions, products, services, representations, warranties or obligations of independent Third Parties, except to the extent specifically required under applicable law.

5. Privacy and Account Security

Casheze respects the privacy of its users and processes personal information in accordance with its Privacy Policy and applicable laws.

Certain portions of the Services may require registration, authentication, User ID, password, OTP or other security credentials.

You are responsible for maintaining the confidentiality of your account credentials and for all activities undertaken through your account.

You must immediately notify Casheze if you suspect unauthorized access, misuse or compromise of your account.

Casheze may suspend or restrict an account where it reasonably believes that unauthorized access, fraudulent activity, misuse or violation of these Terms has occurred.

6. User Registration and Membership

To access certain Services, users may be required to register with Casheze and create an account.

By registering, you represent and warrant that:

1. The information provided by you is accurate, complete and current.
2. You will promptly update your information whenever required.
3. You are legally competent to enter into a binding agreement.
4. Your use of the Services is not prohibited by any applicable law.
5. You shall not create an account using false, misleading or fraudulent information.

Casheze reserves the right to suspend or terminate accounts where the information provided is inaccurate, fraudulent or misleading, or where the user violates these Terms or applicable policies.

7. Account Security

You are responsible for maintaining the confidentiality of your login credentials, passwords, PINs, OTPs and other authentication information.

You shall not share your credentials with any unauthorized person.

Any transaction, instruction or activity initiated through your authenticated account may be treated as having been authorized by you, subject to applicable law and Casheze's policies.

8. Age Requirement

Unless otherwise specifically permitted by applicable law or the relevant Service terms, users must be at least eighteen (18) years of age to register for and use the Services.

Where a particular product or service has additional eligibility requirements, such requirements shall also apply.

9. Inactive Accounts

Casheze may classify an account as inactive where there has been no activity for a prolonged period as determined by Casheze's applicable policies.

Casheze may restrict, suspend or deactivate inactive accounts in accordance with applicable law and internal policies.

Users may be required to complete additional authentication or verification before an inactive account is reactivated.

10. Transactions and Payments

Users shall be responsible for providing correct information while initiating any transaction through the Casheze platform.

Where applicable, transactions may be processed through banks, payment gateways, payment aggregators, merchants, service providers or other Third Parties.

Casheze shall not be responsible for delays, failures, reversals or interruptions caused by circumstances beyond its reasonable control, including banking network issues, payment gateway failures, telecommunications failures, system outages or actions of Third Parties.

Any refund, cancellation, reversal or dispute shall be handled in accordance with the applicable transaction terms, Casheze policies and applicable law.

11. Warranty Disclaimer and Limitation of Liability

Casheze will make reasonable efforts to maintain the availability and functionality of its Services. However, Casheze does not guarantee that the Services will always be uninterrupted, timely, secure, error-free or available at all times.

To the maximum extent permitted by applicable law, Casheze shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profits, business, revenue, data or goodwill arising from the use of or inability to use the Services.

Nothing contained in these Terms shall exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Casheze Technologies India Private Limited, its affiliates, directors, officers, employees, representatives, agents, partners and service providers from claims, losses, liabilities, damages, costs and expenses, including reasonable legal expenses, arising out of or relating to:

• Your use or misuse of the Services.
• Your violation of these Terms.
• Your violation of applicable laws or regulations.
• Any fraudulent, unauthorized or unlawful activity conducted through your account.
• Your infringement of any intellectual property or other rights of Casheze or any Third Party.
• Any information or content submitted by you that violates applicable law or the rights of another person.

13. Applicable Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising out of or relating to these Terms, the Site, Application or Services shall be subject to the jurisdiction of the courts having competent jurisdiction over the registered office of Casheze Technologies India Private Limited, unless otherwise required under applicable law.

14. Changes to Terms & Conditions

Casheze may modify, update or amend these Terms from time to time to reflect changes in its Services, business practices, applicable laws or regulatory requirements.

Updated Terms may be published on the Casheze website or application. Your continued use of the Services after such changes are published shall constitute your acceptance of the revised Terms.

15. Miscellaneous

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall continue to remain in full force and effect.

The failure of Casheze to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision in the future.

These Terms constitute the understanding between you and Casheze concerning your use of the Services and supersede prior communications or understandings relating to the same subject matter, except where otherwise expressly agreed.

16. Information Collection, Use and Communication

By submitting your information through Casheze's website, application, forms or other interfaces, you acknowledge that Casheze may use such information for providing Services, processing transactions, customer support, verification, security, fraud prevention, service updates and other legitimate business purposes in accordance with the Privacy Policy and applicable law.

Where permitted by applicable law, Casheze may communicate with you through telephone, SMS, email, WhatsApp, push notifications or other communication channels regarding transactions, account activity, Services, offers, updates, announcements and other relevant information.

You may manage certain marketing communications in accordance with the options provided by Casheze and applicable law.

17. User Information and Verification

Depending upon the nature of the Services, Casheze may require users to provide information and documents for identity verification, transaction processing, compliance, fraud prevention, risk management or other legitimate purposes.

You agree that all information and documents provided by you shall be genuine, accurate and complete.

Casheze may verify information provided by users through appropriate internal or authorized Third-Party mechanisms.

18. Fraud Prevention and Security

Casheze may employ reasonable technological and operational measures to detect, prevent and investigate fraudulent, suspicious, unauthorized or illegal activities.

Casheze may suspend, restrict or terminate transactions or accounts where it reasonably suspects fraud, misuse, unauthorized activity or violation of applicable laws or policies, subject to applicable law.

Users shall cooperate with Casheze in connection with any reasonable verification or investigation relating to suspicious activity.

19. Grievance Officer

In accordance with the Information Technology Act, 2000, the Consumer Protection Act and applicable rules and regulations, Casheze Technologies India Private Limited shall designate a Grievance Officer, wherever required by applicable law.

The details of the Grievance Officer, including name, email address and contact details, shall be published on the Casheze website and/or application and updated from time to time.
